Terms of Service

1. Introduction

Welcome to EventSwipe by Messer Studios, part of Messer Solutions ("we", "our", "us"). By accessing or using our mobile application ("EventSwipe"), you ("you", "your", "user") agree to be bound by these Terms of Service ("Terms").

2. Definitions

  • "Content" refers to any data, text, graphics, or other materials uploaded, downloaded, or appearing on the Service.
  • "Service" refers to the EventSwipe application as provided by Messer Studios.
  • "Subscription" refers to the periodic billing plans that give users access to premium features of the Service.
  • "In-App Purchases" refers to digital products or services that you can purchase from within the EventSwipe app.

3. Use License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use EventSwipe solely for your personal, non-commercial use.

4. User Accounts

You must be at least 13 years old to use EventSwipe. By creating an account, you affirm that you are at least 13 years of age and capable of entering into this binding agreement.

5. User Conduct

You agree not to use EventSwipe to:

  • Violate any laws or regulations.
  • Infringe on the rights of others.
  • Transmit harmful or malicious software.

6. User Responsibilities

You are solely responsible for your interactions with other users and any content you post. Harassment, bullying, and sending unsolicited inappropriate content are prohibited and may result in termination of your account.

7. Content

Users can join groups, view other users' usernames, profile images, and event preferences. You are responsible for the content you upload and must have the rights to any images or data you provide.

8. In-App Purchases and Subscriptions

8.1 General Terms

By making an in-app purchase or subscribing to our services, you agree to these additional terms.

8.2 Lifetime Subscription

  • The Lifetime Subscription is a one-time payment that grants you access to premium features for the lifetime of the EventSwipe app.
  • Lifetime Subscriptions are non-transferable, neither by app store account or physical device, and cannot be downgraded to a monthly subscription.
  • Refunds for Lifetime Subscriptions are only available as mandated by law or through the respective app store's refund policies. Refunds can be requested by contacting jakob@messerstudios.dev per email, or by any available features offered by the app store (iOS) or play store (Android).

8.3 Monthly Subscription

  • The Monthly Subscription is billed on a recurring basis and will continue until canceled.
  • You may cancel your Monthly Subscription at any time through the subscription management features of the app store where you purchased the subscription (preferred), or by the built-in features of the app.
  • Upgrading from a Monthly Subscription to a Lifetime Subscription will result in the remaining period of the monthly subscription being forfeited.

8.4 Payment and Billing

  • Payment for subscriptions and in-app purchases will be charged to your app store (iOS) or play store (Android) account at confirmation of purchase.
  • Subscription fees are billed in advance on a monthly basis and are non-refundable except as required by law.

8.5 Changes to Pricing and Subscription Plans

  • We reserve the right to modify the pricing of our subscriptions and in-app purchases at any time. Any price changes will be communicated to you in advance and will apply to subsequent subscription periods.

8.6 Termination

  • We reserve the right to terminate or suspend your subscription for any reason, including violation of these Terms. Upon termination, you will not be entitled to any refunds for unused portions of subscriptions.

9. Termination and Suspension

We reserve the right to suspend or terminate your account if you are found to have violated any of our policies, with or without notice. An appeal process is available through our customer service department at jakob@messerstudios.dev.

10. Disclaimer of Warranties

EventSwipe is provided "as is" and "as available" without any warranties, expressed or implied.

11. Limitation of Liability

In no event shall Messer Studios be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of EventSwipe.

12. Governing Law

These Terms shall be governed by the laws of the Kingdom of Sweden, excluding its conflicts of law rules.

13. Intellectual Property

By posting Content on EventSwipe, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such Content in connection with the Service provided by EventSwipe.

14. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of any changes by posting the new terms on EventSwipe. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms of Service.
